These Terms of Service ("Terms") are a binding agreement between you and Instruct LLC, which operates On the Beat ("On the Beat," "we," "us"). They govern your use of the On the Beat app and website (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
What On the Beat does
On the Beat helps fitness instructors plan and run music-mapped indoor cycling classes. The Service lets you build classes from pre-mapped songs, generate class and playlist suggestions, and follow timing while you teach. We may add, change, or remove features over time as we improve the Service.
Eligibility and accounts
You must be at least the age of majority where you live, or have permission from a parent or guardian, to use the Service. You are responsible for the accuracy of the information you provide and for keeping your account secure.
You are responsible for all activity that happens under your account. Keep your login credentials confidential and let us know promptly if you believe your account has been used without your permission. You may delete your account at any time from within the app under Account, then Delete account.
Apple Music and other music services
On the Beat plays music through third-party services such as Apple Music. To play music in a class you need an active, eligible subscription with the music service, and you authorize the connection through that provider (for Apple Music, through Apple's MusicKit). We do not provide the music itself, and we do not receive or store your music service password.
Your use of a connected music service is governed by that provider's own terms and policies, and what is available to play may change based on your subscription, region, and the provider's catalog. On the Beat is not affiliated with, endorsed by, or sponsored by Apple, and Apple Music is a trademark of Apple Inc. We are not responsible for the availability, accuracy, or playback behavior of third-party music services.
Premium membership and billing
On the Beat offers an optional auto-renewing Premium membership. Free accounts can build a limited number of classes and send a limited number of song requests. Premium adds unlimited class building, unlimited song requests, editing and AI revision of any class, PDF class sheets, and class sharing. You never need a Premium membership to open, teach, or keep a class you have already built.
Premium is sold as a monthly or annual auto-renewing subscription. The current price and billing period are shown in the app before you confirm, and the price you see is the price Apple charges in your local currency. Payment is charged to your Apple Account when you confirm the purchase.
Your subscription renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours before the end of the current period. You can manage your subscription or turn off auto-renew at any time in Settings on your iPhone, under your Apple Account then Subscriptions. Cancelling stops future renewals; it does not shorten the period you have already paid for.
Purchases are handled by Apple, so refunds are governed by Apple's policies and are requested through Apple rather than through us. We do not have the ability to issue App Store refunds directly. If a purchase completed but your account did not unlock, use Restore purchases on the Premium screen, and contact us if that does not resolve it.
If we change Premium pricing or what it includes, we will tell you before the change takes effect on your account, and you can cancel before the next renewal if you do not want to continue. If your subscription lapses, your classes remain in your account and stay available to teach.
AI-generated features
On the Beat uses third-party AI providers to generate class and playlist suggestions from the inputs you provide. AI output can be inaccurate, incomplete, or not suited to your needs, and song or timing suggestions may not always match your music service or your class. You are responsible for reviewing what the Service generates and for deciding what to use in your classes. AI-generated suggestions are not professional advice.
Acceptable use
You agree not to:
- Break the law or infringe anyone's rights, including intellectual property rights.
- Violate the terms of any connected service, or use the Service to obtain or distribute music or other content you are not authorized to use.
- Access the Service through automated means, scrape it, or try to copy, resell, or redistribute it without our permission.
- Interfere with or disrupt the Service, attempt to gain unauthorized access to it, or probe, scan, or test its security.
- Upload malware, or misuse the Service in a way that harms us or other users.
Your content
You keep ownership of the classes, playlists, preferences, and other content you create. You grant us the limited rights we need to host, process, and display that content so we can operate and improve the Service for you. You are responsible for the content you create and for making sure you have the rights to use it.
Our intellectual property
The Service itself, including its software, design, and branding, belongs to us or our licensors and is protected by intellectual property laws. We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. These Terms do not grant you any rights to our trademarks or to the trademarks or content of third parties such as music services.
Disclaimers and warranties
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any content or suggestion will be accurate or suitable for your class.
On the Beat is a planning and playback tool, not a substitute for professional or medical judgment. Indoor cycling is physical exercise. You are responsible for teaching and exercising safely, for the well-being of your participants, and for consulting a qualified professional where appropriate. You use the Service at your own risk.
Limitation of liability
To the fullest extent permitted by law, Instruct LLC and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us, if any, for the Service in the twelve months before the claim. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
Termination
You can stop using the Service and delete your account at any time. We may suspend or end your access to the Service if you violate these Terms or use the Service in a way that could cause harm or legal risk. Provisions that by their nature should survive, such as the disclaimers, limitation of liability, and ownership terms, will survive termination.
Changes to these Terms
We may update these Terms from time to time. We will update the "Last updated" date above and, where appropriate, notify you in the app. Your continued use of the Service after changes take effect means you accept the updated Terms.
Governing law
These Terms are governed by the laws of the United States and the state in which Instruct LLC is organized, without regard to conflict-of-law rules. The Service is operated from the United States.
